…and to my shock, it might actually go to trial
A Hawaiin resident, Craig Smallwood is reportedly suing NCsoft for not selling their MMORPG Lineage II title with a warning label against addiction. Smallwood is claiming that his life was ruined because of the game, and now he is seeking $3 million in compensation. This is not the first case reported with this storyline but it is shocking to hear that the U.S. District Court Judge Alan Kay refused to dismiss parts of the complaint and therefore it could ultimately lead to trial.
This story was spotted by Wired who reported that Smallwood claims to have played Lineage II for more than 11 hours a day for five straight years. He got so addicted that he became unable to “function independently in usual daily activities such as getting up, getting dressed, bathing, or communicating with family and friends.”
The case went back and forth, as legal battles do, with amended complaints and NCSoft getting the case thrown out over technicalities. With NCsoft’s latest request to the court to dismiss a freshly amended complaint, the judge refused, so we might actually have a real trial going down over the addiction of gaming.
